Florida Rule of Civil Procedure and section Florida Statutes requests a case management conference and states This matter is special set for a 10-day jury trial commencing on March Pursuant to the parties Pretrial Stipulation the first issue to be tried is Epsteins case against Defendant Scott Rothstein to determine the damages sustained by Epstein and proximately caused by Rothstein The second issue that will be tried is Counter-Plaintiff Bradley Edwards Edwards malicious prosecution counterclaim against Epstein In order for the parties to properly prepare for trial Epstein respectfully requests a case management conference to comply with section Florida Statutes and to address the following FILED PALM BEACH COUNTY FL SHARON BOCK CLERK PM a Plaintiff Epsteins time for jury selection Counter-Plaintiff Edwards time for jury selection peremptory challenges and voir dire questions The Courts timing and procedures for the jury instruction charge conference pursuant to Florida Rule of Civil Procedure Amount of time allowed for opening statements closing arguments and rebuttal if any and sequence of rebuttal Sequence of claims and witnesses i.e because Epstein as Plaintiff against Rothstein will put his case on first will Edwards be allowed to inject new issues through cross examination of the witnesses presented during Epsteins case against Rothstein even though Edwards is not a party to that claim See Steinhorst State So 2d Fla If a party seeks to elicit testimony from an adverse witness which goes beyond the scope encompassed by the testimony of the witness on direct examination other than matters going to credibility he must make the witness his own Stated more succinctly this rule posits that a party may not use cross-examination as a vehicle for presenting
